Minor Offences & Magistrates’ Court
All criminal cases begin in the Magistrates' Court, with offences classified into three categories - summary only, either way and indictable only.
Classification - Court - Example Offences
Summary Only - Magistrates' Court Only - common assault, drunk and disorderly behaviour, low level shoplifting, minor road traffic offences (e.g., speeding, driving without due care and attention)
Either Way - Magistrates' Court / Crown Court - theft, burglary, assault occasioning actual bodily harm, possession of drugs with intent to supply
Indictable Only* - Crown Court Only - murder, rape, robbery, grievous bodily harm with intent
*For those aged 17 or under, certain indictable-only offences for adults may be dealt with in the Youth Court.
Magistrates’ Court - Process
After being charged or summonsed, all cases initially appear in the Magistrates' Court. If the offence is indictable only, it is immediately sent to the Crown Court.
For either-way offences, the Magistrates initially decide whether they can hear the case or if it should be sent to the Crown Court, based on the seriousness of the offence(s) charged. Even if the Magistrates agree to hear the case, they may still refer it to the Crown Court for sentencing if deemed appropriate. Additionally, you have the right to elect for your trial to be held at the Crown Court if you prefer.
